On private photo pages I can see because I am member of the group it appears in, the script always show the not-commented icon, also If I commented on the photo.
I think this is because the api doesn't have access to these photo's and their comments.
Therefore there should be a third status. "Commented on", "not commented on" and "can't check". Maybe a balloon with a red cross or a purple balloon (like the private icon) or something else...
